3. User Obligations

3.1 For Job Seekers/Candidates

• Provide accurate, complete, and up-to-date information in your profile and applications
• Maintain the confidentiality of your account credentials
• Use the services only for lawful purposes
• Not submit false, misleading, or fraudulent information
• Respect the intellectual property rights of Sarnak Recruiting and third parties
• Not engage in any activity that may harm, disrupt, or interfere with our services

3.2 For Clients/Employers

• Provide accurate job descriptions and requirements
• Comply with all applicable employment laws and regulations
• Treat candidates with respect and professionalism
• Honor commitments made to candidates and Sarnakrecruiter
• Pay all fees and charges as agreed in service contracts
• Maintain confidentiality of candidate information

4. Account Registration

To access certain features of our services, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information is accurate and current

5. Fees and Payment

Some of our services may require payment of fees. All fees are specified in service agreements or as displayed on our website. Payment terms, including due dates and methods, will be communicated to you. Failure to pay fees when due may result in suspension or termination of services. All fees are non-refundable unless otherwise specified in writing.

6. Intellectual Property Rights

All content on our website, including text, graphics, logos, images, software, and other materials, is the property of Sarnak Recruiting or its licensors and is protected by copyright, trademark, and other intellectual property laws. This includes candidate information, client business information, and proprietary data. Confidentiality obligations continue even after the termination of our services agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Sarnak Recruiting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to the use of our services. Our total liability for any claims shall not exceed the amount paid by you for our services in the twelve (12) months preceding the claim.

9. No Guarantee of Placement

While we strive to provide quality recruitment services, we do not guarantee that candidates will be placed in positions or that clients will find suitable candidates. Placement success depends on various factors beyond our control, including market conditions, candidate qualifications, and client requirements.

10. Prohibited Activities

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services or servers
• Use automated systems to access our services without permission
• Impersonate any person or entity
• Collect or harvest information about other users

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, for violation of these Terms and Conditions or for any other reason we deem appropriate. Upon termination, your right to use our services will immediately cease, and we may delete your account and related information.

If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Greater Noida, Uttar Pradesh, India, and shall be governed by the laws of India.

We shall not be liable for any failure or delay in performance under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party service providers.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Sarnakrecruiter regarding the use of our services and supersede all prior agreements and understandings.
